These Terms of Service ("Terms") govern your use of the Cashed Out mobile application (the "App") operated by Cashed Out ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Important Health Disclaimer

Cashed Out is a self-help tool designed to support gambling recovery. It is NOT a substitute for professional medical advice, diagnosis, treatment, therapy, or counseling.

The App, including the Marcus AI companion feature, does not provide medical, psychological, or therapeutic services. The content and features within the App are for informational and self-help purposes only.

2. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the App under any circumstances.

3. Account Registration

• You may use certain features of the App anonymously without creating an account.
• If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating your account.
• You must notify us immediately of any unauthorized use of your account.

4. AI Companion Disclaimer

The App includes Marcus, an AI-powered recovery companion. By using this feature, you acknowledge and agree that:

• Marcus is an artificial intelligence program, not a human being, licensed counselor, therapist, or medical professional.
• Responses generated by Marcus are created by AI technology and may not always be accurate, complete, or appropriate for your specific situation.
• Marcus is designed to provide general recovery support and encouragement. It does not diagnose conditions, prescribe treatments, or replace professional care.
• Your conversations with Marcus are processed by third-party AI services (Anthropic) as described in our Privacy Policy.
• You should not rely solely on Marcus for critical decisions related to your health, safety, or recovery.

5. Community Guidelines

The App includes a community feed where users can share posts and comments. By participating, you agree to:

• Be respectful: No harassment, bullying, hate speech, or personal attacks.
• No promotion of gambling: Do not share gambling tips, strategies, referral links, or content that encourages gambling.
• No illegal content: Do not post content that violates any applicable law or regulation.
• No spam or self-promotion: Do not use the community for advertising or commercial purposes.
• No personally identifiable information: Do not share other people's personal information without their consent.
• Keep it supportive: The community exists to support recovery. Content that undermines this purpose may be removed.

We use AI-powered content moderation to help enforce these guidelines. We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

6. User Content

• You retain ownership of all content you create and submit through the App (posts, comments, check-in data, etc.).
• By posting content to the community feed, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make that content available to other users within the App.
• You represent that you have the right to post any content you submit and that it does not infringe on the rights of any third party.
• You may delete your content at any time. Deleting your account removes all associated content permanently.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the App, other accounts, or our systems.
• Interfere with or disrupt the App's functionality or servers.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated systems (bots, scrapers) to access the App.
• Impersonate any person or entity.
• Use the App to collect information about other users without their consent.

8. Site Blocker Feature

The App includes an optional Safari Content Blocker extension that blocks access to gambling websites. By using this feature, you acknowledge that:

• The blocker works within Safari only and does not affect other browsers or apps.
• The list of blocked sites may not be exhaustive. New gambling sites may not be immediately blocked.
• The blocker is a tool to support your recovery, not a guarantee against accessing gambling content.
• You can enable or disable the blocker at any time through your device's Settings.

9. Intellectual Property

The App and its original content (excluding user-generated content), features, and functionality are owned by Cashed Out and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Account Termination

• By you: You may delete your account at any time from the Settings screen within the App. This permanently removes all your data.
• By us: We may suspend or terminate your account if you violate these Terms, engage in behavior that harms other users or the community, or for any other reason at our sole discretion. We will make reasonable efforts to notify you before or at the time of termination.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• The results obtained from using the App will be accurate or reliable.
• Any defects in the App will be corrected.
• The App will meet your specific recovery needs or goals.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASHED OUT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App.
• Any conduct or content of any third party on the App.
• Any content obtained from the App, including AI-generated responses.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless Cashed Out and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.

15. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms within the App or on our website. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cashed Out regarding the use of the App and supersede any prior agreements.
